These Terms of Service ("Terms") govern your use of winsomeconcepts.com, our social media pages, and any purchase you make from us (together, the "Services"). The Services are operated by Winsome Concepts, LLC, a Texas limited liability company based in Dallas, Texas ("Winsome," "we," "us," or "our").
By visiting our website or placing an order, you agree to these Terms. If you do not agree, please do not use the Services.
1. Eligibility
You must be at least 18 years old, or the age of majority where you live, to make a purchase. If you are younger, you may use the Services only with the involvement of a parent or guardian.
2. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date and takes effect when posted. Orders placed before an update are governed by the Terms in effect when the order was placed.
3. Orders, pricing and payment
All prices are listed in U.S. dollars and may change without notice. Prices do not include applicable sales tax, which is added at checkout. For international orders, any duties, import taxes and customs fees are the responsibility of the customer.
Your order is an offer to purchase. We reserve the right to accept, limit or cancel any order, including after an order confirmation has been sent, for reasons such as limited availability, a pricing or listing error, or suspected fraud. If we cancel an order after payment, we will issue a full refund to your original payment method.
We may limit quantities per person, household or order. Many of our pieces are produced in limited releases, and once a release sells through it may not be restocked.
4. Product descriptions and handcrafted variation
We take care to describe and photograph our products accurately. Because each piece is hand cut and hand sewn, small variations in pattern placement, stitching, color and texture are natural and are part of the character of the piece, not a defect. Colors may also appear differently depending on your screen.
If we discover an error in a product description, price or availability, we may correct it at any time, including after an order is placed.
5. Shipping
We offer complimentary shipping within the United States. International orders are charged shipping at checkout. Delivery times are estimates and are not guaranteed. Title and risk of loss pass to you when your order is handed to the carrier.
Lost or stolen packages. If your package is marked delivered but has not arrived, or appears lost in transit, contact us at concierge@winsomeconcepts.com. We will work with the carrier on a claim, but we are not responsible for packages that are lost or stolen after delivery to the address you provided.
6. Cancellations and returns
Cancellations. You may cancel an order within 24 hours of placing it, or before you receive a shipping confirmation, whichever comes first. Once an order has shipped, it can no longer be cancelled and is subject to our return policy.
Returns. We accept returns within 14 days of delivery. Items must be new, unused and unmarked, with original packaging, including the dust bag and box. Customers are responsible for return shipping costs. Once we receive and inspect the item, we will issue a refund to the original payment method. Original shipping charges on international orders are not refundable.
7. Our Quality Promise
For one year from delivery, we will repair or replace any Winsome piece with a seam, stitching or closure failure under normal use. This promise does not cover cuts, crushing, stains, water damage, normal wear, or damage from misuse or accidents. To make a claim, email concierge@winsomeconcepts.com with your order number and photos of the issue.
Except for this promise and as required by law, our products are sold without other warranties (see Section 13).
8. Authorized sellers
Genuine Winsome products are sold through winsomeconcepts.com and our authorized retail partners. Products bought from any other source are purchased at the buyer's own risk and are not covered by our returns policy or Quality Promise.
9. Intellectual property
The Winsome name, logo, emblem, product names, designs, photography, text and all other content on the Services belong to Winsome Concepts, LLC or its licensors and are protected by trademark, copyright and other laws. You may view and share our content for personal, non-commercial purposes, such as sharing a product link. You may not copy, reproduce, modify or use our designs, branding or content for commercial purposes without our written permission.
10. Use of the Services
You agree not to:
- Use the Services for any unlawful or fraudulent purpose
- Purchase products for unauthorized resale
- Use bots, scrapers or other automated tools to access the Services or place orders
- Interfere with the security or operation of the website
- Impersonate Winsome or misrepresent an affiliation with us
We may refuse service, cancel orders or restrict access to anyone who violates these Terms.
11. Accounts
If you create an account, you are responsible for keeping your login details secure and for all activity under your account. Please contact us right away if you believe your account has been used without your permission.
12. Privacy
Our Privacy Policy explains how we collect, use and protect your personal information, and is part of these Terms.
13. Disclaimers
EXCEPT FOR OUR QUALITY PROMISE AND AS REQUIRED BY LAW, THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We do not guarantee that the website will be uninterrupted, error-free or free of viruses.
Our cases are designed to store and carry watches and personal items. Winsome is not responsible for loss of, or damage to, any watch, jewelry or other item stored in or carried with our products.
14. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WINSOME WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR OUR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow these limitations, so they may not fully apply to you.
15. Indemnification
You agree to indemnify and hold harmless Winsome Concepts, LLC and its owners and agents from any claims, losses or expenses, including reasonable attorneys' fees, arising from your violation of these Terms or misuse of the Services.
16. Disputes and governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law rules. If you have a concern, please contact us first at concierge@winsomeconcepts.com so we can try to resolve it informally. If a dispute cannot be resolved within 30 days, either party may bring an individual claim in small claims court, or otherwise in the state or federal courts located in Dallas County, Texas, and you consent to the jurisdiction of those courts.
17. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver of it. You may not transfer your rights under these Terms. These Terms and our Privacy Policy are the entire agreement between you and Winsome regarding the Services.
